The Impact Of Divorce Laws On Marriage
Throughout the last half-century, many American marriages have been shaped by divorce law. These reforms have had some significant impact on household behavior, including how married couples save and invest, and the quality of their marriages. Moreover, divorce has had a direct impact on adults and children. Although it is commonly believed that divorce makes a good marriage stronger, a number of social scientific studies have revealed that the myth is not true.
Divorce can be devastating to a child’s emotional and social well-being
Divorce can undermine a couple’s ability to invest in their marriage, reducing the likelihood of the couple having a thriving marriage. It can also lead to an emotional spiral. When a couple’s relationship breaks down, the consequences can be felt disproportionately by less-educated people. In particular, children of lower-income parents are doubly disadvantaged.
In the United States, the institutional model of marriage favored sticking together until the children were grown. In the 1970s and 1980s, a sexual revolution fueled a tumultuous period of marital turmoil. In some cases, the husbands found it easier to find extramarital partners, bringing about the divorce rates that we see today. In other instances, couples entered into a no-fault divorce regime, which gave the husband more power to leave the marriage without the wife’s consent.
However, the institutional model of marriage has been largely jettisoned in the United States. A more soul-mate model of marriage prioritizes the emotional well-being of the couple and gives the couple moral permission to leave a marriage for virtually any reason. This has allowed parents to move on from unhappy marriages.
