Child Support Guidelines
Whether you are a non-custodial parent or the custodial parent, it is important to understand the rules governing child support. The purpose of child support is to provide for the needs of a child. These payments can include medical care, education, and other expenses. The child support formula is based on the parents’ incomes and the custody arrangement.
When a parent is granted full custody of a child, the court may order the other parent to pay child support. This is done through a series of periodic payments. If the non-custodial parent’s income changes, the support payments may be adjusted. When there is an adjustment, the party who is receiving support is notified and has the right to request a review of the case. If the parties cannot agree on the change, a Support Magistrate or court hearing may be held to determine a new Support order.
If you have joint custody of your child, the amount of child support you pay to the other parent will depend on how much time you spend with the child. The child support owed will be lower if the parent who spends more time with the child is earning a higher income. The other parent may also be required to pay a portion of the child’s expenses. If the other parent has joint custody, he or she may contribute in unequal amounts to the child’s expenses.
If the child’s parents are living in different counties, an interstate case may be filed in the Family Court of the county where the parent who is receiving support lives. If the child has lived in the other county for at least three years, a petition for child support can be filed in the county where the child is currently residing.
