A Child May Live With The Custodial Parent
Obtaining custody of your child is not always easy. In fact, the process can take a very long time. A court order will not change unless there is a significant change in the situation.
A judge will decide on the best custody arrangement for your child. This is done by looking at a number of factors, including the child’s preferences, the parents’ lifestyles, the parent’s ability to care for the child, and more. The court will also consider the age of the child. If the child is older, the judge will give more weight to his or her wishes.
Depending on the circumstances, a non-custodial parent can have access to the child’s school activities and medical information. He or she can also have a power of attorney allowing him or her to take care of the child. The power of attorney can be revoked by the parent.
In some cases, a judge will order the other parent to go through medical examinations and other steps to find out what is in the best interest of the child. The judge may also interview the child privately to gather information. In other cases, the judge will appoint a guardian ad litem, who will represent the interests of the child during the proceedings.
If the judge makes a decision based on the parents’ agreement, the other parent has a right to know what the agreement is and to accept it. If the other parent does not agree with the agreement, he or she has the right to file a petition to modify the agreement in a Family Court. The petition must contain a statement that shows that the proposed modification is in the child’s best interest. The parent must show that there has been a significant change in the circumstances since the last court order was made.
